When a Madison County resident dies, the named executor or an interested party files a petition with the Probate Court to open the estate. If there is a will, the court determines its validity and appoints the personal representative named in the document. In intestate cases (where no will exists), the court appoints an administrator according to Alabama’s statutory preference order. The personal representative must inventory estate assets, notify creditors, settle valid claims, file accountings with the court, and distribute remaining assets to beneficiaries or heirs.
Contested matters, including will challenges, may be transferred from the Probate Court to the Circuit Court. The transfer fee is $52.50.
Guardianship and Conservatorship
Petitions for guardianship of a minor or incapacitated adult, as well as conservatorship of an individual’s estate, are filed in the Probate Court. The court evaluates the proposed guardian’s or conservator’s fitness and may require annual reports on the protected person’s welfare and financial status. These filings become part of the court record and are generally accessible to the public, though medical evaluations and other sensitive reports may be restricted by court order.
For forms, filing instructions, and additional resources, the Alabama Administrative Office of Courts website provides statewide legal information and links to electronic filing and court forms.
