Are Warrants Public Information in Alabama?

Arrest warrants and bench warrants are generally public records in Alabama once they have been executed or once the underlying case is part of the court file. Alabama's public records statute, Code of Alabama § 36-12-40, grants every citizen the right to inspect and copy any "public writing" held by a government office, unless a specific statutory exemption applies. The language is broad — it covers records maintained by courts, clerks, and law enforcement alike — but the statute only guarantees the right of inspection, not proactive online publication.

That distinction matters in practice. A bench warrant issued under Code of Alabama § 15-10-60 for failure to appear before a grand jury indictment, or an arrest warrant issued under § 15-7-4, is part of the court record and is not typically sealed. Search warrants, by contrast, are almost always sealed during an active investigation and may remain so indefinitely if no charges are filed. Warrants tied to sealed juvenile proceedings or grand jury proceedings are likewise withheld from public access.

Even for records that are legally public, availability varies dramatically by county. Some Alabama sheriff's offices publish active warrant lists on their websites or Facebook pages; many do not. How Long Is a Warrant Active in Alabama?
